Hi . . . my wife and I are interested in immigrating to Costa Rica from New Zealand. We have a property that we’re interested in buying in the Puntarenas area but there are title issues that concern us. The property has no title because it’s in “Indian Reserve land”. We are told that it has been granted “total right of private ownership by the Indian Tribal Council”. The owner has this documentation showing “full rights to his land”, as well as a letter from a “top judge in the country” who has “ruled in his favor” and “will uphold his total rights”.

Who would you recommend to assist us in understanding the ramifications of this and potential liabilities?

    Thanks very much!

    Hi Xakan,

I would recommend being very cautious in purchasing property with all those caveats. There is plenty of land with clear title in Costa Rica. No need to get involved in this sort of thing.

Roger Petersen, a Costa Rican attorney, might be able to clear some things up for you: http://www.plawcr.com.
